TERMS OF SERVICE

1. Agreement

These Terms of Service ("Terms") govern your use of the UnPhiltered Trivia platform ("Service") operated by UnPhiltered Trivia LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

UnPhiltered Trivia is a live trivia hosting platform that allows hosts to create and run trivia events. Players participate by joining a game session via a room code on their own devices. The Service includes the host dashboard, player interface, venue display screen, and related features.

3. Accounts

You must create an account to use the Service as a host. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to create an account. You agree to provide accurate information and to keep it up to date.

4. Subscriptions and Billing

The Service is offered on a free tier and a paid Pro tier. Pro subscriptions are billed monthly at the rate displayed at the time of purchase. Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

We reserve the right to change subscription pricing with at least 30 days' notice to your registered email address.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Upload or distribute content that is illegal, defamatory, obscene, or harmful
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Interfere with or disrupt the Service or servers connected to it
  • Use the Service to collect personal information from players without their consent

6. Content

You retain ownership of any trivia content (questions, answers, game data) you create or upload to the Service. By submitting content, you grant us a limited license to store and display it solely for the purpose of operating the Service on your behalf. We do not claim ownership of your content.

You are responsible for ensuring your content does not infringe the intellectual property rights of others.

7. Availability

We strive to keep the Service available but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our control. We are not liable for any disruption to your events caused by downtime.

8. Limitation of Liability

To the fullest extent permitted by law, UnPhiltered Trivia LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, loss of data, or disruption to live events. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct harmful to the Service or other users. You may delete your account at any time by contacting us. Upon termination, your access to the Service ends and your data may be deleted after a reasonable retention period.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Clarke County, Georgia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
